Thailand Marriage Registration for Dutch Nationals

Dutch citizens can legally register their marriage in Thailand, whether they are marrying a Thai national, another Dutch citizen, or a foreign partner of another nationality. However, like all foreign nationals, Dutch citizens must prepare specific documents before the marriage can be officially registered at a Thai District Office.

A religious or symbolic wedding ceremony alone does not create a legal marriage in Thailand. The marriage becomes legally valid only after it has been registered at a Thai District Office, also known as an Amphur or Khet.

Certificate of Legal Capacity to Marry

Dutch nationals are required to obtain a document confirming that they are legally free to marry. This document may be referred to as a Certificate of Legal Capacity to Marry or a Declaration of Marital Status.

This certificate confirms that the Dutch citizen is not currently married, is legally eligible to marry, and has no legal obstacle preventing the marriage. The document must be issued by the Dutch authorities and is normally processed through the Embassy of the Netherlands in Bangkok.

Applying Through the Dutch Embassy in Bangkok

Dutch nationals must complete the required application form and make an appointment with the Dutch Embassy. The appointment is usually made through the embassy’s online appointment system under the category related to a declaration of marital status.

In many cases, the required documents must be prepared as PDF files and submitted to the embassy by email. Photos of documents may not be accepted.

The embassy may request the following information by email:

  • Full name of the Dutch applicant

  • Contact telephone number

  • Purpose of the declaration

  • Subject of the email

  • Mailing preference, if the applicant wants the document sent by post

Documents Required for Dutch Nationals Who Have Never Been Married

If the Dutch citizen has never been married before, the following documents are usually required:

  • Valid Dutch passport or Dutch ID card

  • Proof of residential address

  • Official proof of unmarried status issued by a Dutch or foreign government authority

  • Copy of the partner’s valid passport or ID card

Proof of address may include a municipal registration document, recent bank statement, utility bill, or rental contract showing the applicant’s name and current address.

Documents Required for Dutch Nationals Who Were Previously Married

If the Dutch citizen was previously married, additional documents will be required. These may include:

  • Valid Dutch passport or Dutch ID card

  • Proof of residential address

  • Divorce certificate or court divorce decision

  • Proof of termination of a previous registered partnership, if applicable

  • Death certificate of the former spouse, if applicable

Non-Dutch documents may need to be translated and legalized before they can be accepted.

Additional Requirements for Dutch Citizens Living Outside the Netherlands

If the Dutch national lives outside the Netherlands, additional local documents may be required to confirm their marital status. These documents may include immigration registration, tax documents, insurance records, or other official papers showing that the applicant is not married or is legally divorced.

If an official unmarried-status document cannot be obtained, the applicant may need to provide alternative supporting documents.

Partner Attendance at the Embassy

The non-Dutch partner is usually not required to attend the embassy appointment. However, a copy of the partner’s valid passport or identification document may still be required when applying for the declaration.

Witness and Income Form

When preparing to marry in Thailand, Dutch nationals may also be required to complete a witness and income form. The form may ask for the names of two Dutch witnesses. These witnesses do not normally need to be physically present at the marriage registration in Thailand.

Embassy and Legalization Fees

The consular statement issued by the Dutch authorities may involve an embassy fee. Additional postal charges may apply if the applicant requests the document to be sent by mail.

After the Dutch document is issued, it must normally be translated into Thai and legalized by the Thai Ministry of Foreign Affairs. Legalization fees at the Thai Ministry of Foreign Affairs may vary depending on the service type and processing speed.

Translation and Legalization in Thailand

Once the Certificate of Legal Capacity to Marry or Declaration of Marital Status has been issued, it must be translated into Thai by a qualified translator.

The original document and the Thai translation must then be submitted to the Thai Ministry of Foreign Affairs for legalization. If the applicant has divorce documents, death certificates, or other supporting documents, these may also need to be translated and legalized.

The Dutch Embassy does not normally prepare Thai translations, so the applicant must arrange translation services separately.

Marriage Registration at the Thai District Office

After the required documents have been translated and legalized, the couple may proceed with the marriage registration at a Thai District Office.

The couple should prepare the following documents:

  • Dutch passport

  • Copy of passport biodata page

  • Thai entry stamp or visa page, if applicable

  • Legalized Certificate of Legal Capacity to Marry or Declaration of Marital Status

  • Thai translation of the required documents

  • Any divorce or death certificate, if applicable

  • Partner’s passport or Thai ID card

  • Thai house registration document, if the partner is Thai

  • Two witnesses for the marriage registration

If the partner is Thai and under 20 years old, written parental consent may be required.

The District Office registrar has the authority to review the documents and may request additional supporting documents before approving the marriage registration.

Prenuptial Agreement

If the couple has a prenuptial agreement, it should be presented to the registrar before or during the marriage registration process. A prenuptial agreement should be recorded at the time of marriage registration in order to be officially recognized.

Thai Marriage Certificate

After the marriage registration is completed, the couple will receive a Thai marriage certificate. The certificate is issued in Thai.

For use in the Netherlands or other countries, the couple may need to arrange a certified translation of the Thai marriage certificate. The translated document may also need to be legalized, depending on the purpose and the authority requesting it.

Registering the Marriage in the Netherlands

Dutch citizens may choose to register their Thai marriage in the Netherlands. This may be useful for official records, future visa applications, family matters, or replacing documents if the original Thai marriage certificate is lost.

Registration in the Netherlands is not always a legal requirement, but it is often recommended for convenience and future administrative use.

Important Notes for Dutch Nationals

Marriage in Thailand does not automatically grant Dutch citizenship to a foreign spouse.

If the Dutch citizen’s spouse wishes to visit or live in the Netherlands, the spouse may need to apply for the appropriate Dutch visa or residence permit.

If the couple plans to live in Thailand after marriage, the foreign spouse may be eligible to apply for a Thai marriage visa, depending on nationality, immigration status, and Thai immigration requirements.
